By creating an account, accessing, or using HGVHQ, you explicitly agree to these Terms and acknowledge that HGVHQ is a software platform only.
1. Nature of HGVHQ
HGVHQ provides software tools to assist tradespeople in managing their own business operations.
HGVHQ:
- Does not provide trade services
- Does not act as a contractor, employer, dispatcher, or agent
- Does not enter into agreements with your customers
- Does not control or verify data entered by users
You acknowledge that you are using HGVHQ entirely at your own discretion and risk.
2. Your Full Responsibility
You are solely and entirely responsible for:
- All data entered into the platform
- All customer information stored
- All messages sent
- All jobs, invoices, and records
- Compliance with GDPR and privacy laws
- Any agreements or disputes with your customers
You acknowledge that HGVHQ has no knowledge of, or control over, the data you input.
3. Explicit Liability Waiver
By using HGVHQ, you agree that HGVHQ cannot and will not be held liable for:
- Loss of earnings
- Missed jobs
- Customer disputes
- Data loss caused by user actions
- Messages sent through the system
- GPS or mapping inaccuracies
- Service downtime
- Any business losses whatsoever
4. Payments
All payments are processed by third-party providers. HGVHQ does not store card details and is not responsible for disputes, chargebacks, or fraud.
All prices are shown exclusive of any applicable taxes. HGVHQ is not currently VAT registered. If VAT becomes chargeable in the future, it will be added to your subscription and any other taxable charges at the prevailing rate.
5. Indemnity
You agree to fully indemnify, defend, and hold harmless HGVHQ from any claim, legal action, loss, fine, or damage arising from:
- Your use of the platform
- Your data
- Your communications
- Your breach of GDPR or privacy law
- Your business activities
6. Limitation of Liability
To the maximum extent permitted by law, HGVHQ's total liability is limited to the fees you paid in the previous 3 months.
7. Acceptance
If you do not agree with these terms, you must not use HGVHQ.
